Divorce is the legal process which brings a marriage to legal process to an end.  You will receive a final decree absolute, which shall terminate your marriage and end your marital obligations permanently.  

The criteria for obtaining a divorce is that the parties must have been married for at least a year, that the marriage has irretrievably broken down and that the marriage must be legally recognised in the UK. The person who petitions for divorce has to show that one of the following facts applies as a reason for the breakdown:

  • Your spouse has committed adultery and you find it intolerable to live with them
  • Your spouse has behaved in such a way that you cannot reasonably be expected to live with them.
  • Your spouse has deserted you and you have lived apart for more than two years.
  • You have lived apart for more than two years and your spouse consents to the divorce.
  • You have lived apart for more than five years (spousal consent is not required).

If the Judge believes that one of the above ground has been proved, the Judge will grant a Decree absolute.

The divorce procedure is usually carried out administratively and parties will not be required to attend Court unless the divorce is defended or you are ordered to do so by the Court.

In certain circumstances, the marriage itself may be void or voidable. In this case you may wish to instigate annulment proceedings. We will be able to advise you on the merits of each case at an initial consultation.

Judicial Separation

Judicial separation if the formal way in which a party can separate from their spouse. The process is similar to a divorce, however you will remain legally married to your spouse. Your marital obligations will come to an end.
